These Terms of Use (the “Terms”) govern your use of the mobile game application Maze Paint: Color Fill Puzzle (also referred to as “Maze Paint”), including its game features, content, advertisements, and related services (collectively, the “Services”), provided by Koh Kobayashi (“we,” “us,” or “our”).

By installing, launching, accessing, or using Maze Paint, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

#1. Definitions

For the purposes of these Terms:

“User” or “you” means any individual who installs, accesses, or uses the Services.

“App” means Maze Paint: Color Fill Puzzle and any related software, updates, or content provided by us.

“Content” means all content contained in or made available through the Services, including game levels, puzzles, layouts, graphics, artwork, animations, visual effects, sounds, music, user interfaces, text, software, code, game mechanics, data, and other materials.

“Game Data” means progress data, settings, gameplay history, level completion information, preferences, and any other data generated through your use of the Services.

“Third-Party Services” means services operated by third parties, including but not limited to the Apple App Store, Google Play, advertising providers, analytics providers, operating system providers, and other external platforms or service providers.

#2. Agreement to These Terms

You may use the Services only if you agree to these Terms and our Privacy Policy.

If you are under the age at which you may legally enter into an agreement in your country or region, you must obtain permission from your parent or legal guardian before using the Services.

If a minor uses the Services, the parent or legal guardian should appropriately supervise such use, including the minor’s interaction with advertisements and Third-Party Services.

#3. Changes to These Terms

We may modify these Terms when reasonably necessary, including due to:

• changes to applicable laws or regulations;
• changes to the Services;
• changes to advertising or Third-Party Services;
• technical, operational, or security requirements; or

other reasonable circumstances related to the operation of Maze Paint.

When material changes are made, we may provide notice through the App, our website, the applicable app store listing, or another reasonable method.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

If you do not agree to the revised Terms, you must stop using the Services.

#4. License to Use Maze Paint

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Maze Paint solely for your personal, non-commercial entertainment purposes.

This license does not transfer ownership of the App, Content, game systems, Game Data, intellectual property, or any related rights to you.

All rights not expressly granted under these Terms are reserved by us or the applicable rights holders.

You may not use Maze Paint or its Content for commercial purposes unless we have expressly provided prior written permission.

#5. No User Account

Maze Paint does not currently require or provide a user account or login system.

Game Data may be stored locally on your device or otherwise handled through technical functions of your device, operating system, or applicable Third-Party Services.

Because Maze Paint does not provide an independent user account system, we may not be able to restore Game Data if it is lost as a result of:

• deleting or reinstalling the App;
• changing or resetting your device;
• changing operating systems or devices;
• device failure or loss;
• storage corruption;
• operating system updates;
• App updates;
• failures or changes involving Third-Party Services; or

other technical causes outside our reasonable control.

You are responsible for appropriately managing your device and any backups made available through your device or platform.

#6. Advertisements

Maze Paint may display advertisements, including:

• rewarded video advertisements;

interstitial advertisements; and

other advertising formats that may be introduced in the future.

Advertisements may be provided by third-party advertising providers.

Your interaction with advertisements may be governed by the terms, privacy policies, and practices of the applicable advertiser, advertising provider, or other third party.

Rewarded Advertisements

Maze Paint may offer optional in-game benefits or features in exchange for watching rewarded advertisements.

We do not guarantee that rewarded advertisements will always be available.

A rewarded advertisement or related reward may fail to display, complete, or be granted due to circumstances including:

• lack of available advertisements;
• communication failures;
• device or operating system restrictions;
• advertising provider failures;
• App interruption or termination;
• fraud-prevention systems;
• invalid or incomplete advertisement viewing; or

other technical circumstances.

Where reasonably possible, we may attempt to properly reflect legitimate earned rewards, but we do not guarantee uninterrupted availability of advertisements or rewards.

You must not attempt to fraudulently obtain advertising rewards or manipulate advertising systems.

#7. Prohibited Conduct

You must not engage in any of the following activities in connection with the Services:

Violating applicable laws, regulations, these Terms, app store rules, or applicable Third-Party Service terms.

Using the Services for fraudulent, illegal, abusive, or unauthorized purposes.

Exploiting bugs, errors, vulnerabilities, unintended game behavior, or technical defects to obtain an unfair advantage or improperly alter gameplay.

Cheating, hacking, modifying, tampering with, or manipulating the App, Game Data, level data, game progress, or other technical elements.

Reverse engineering, decompiling, disassembling, decoding, modifying, or attempting to obtain the source code of the App, except to the extent such restriction is prohibited by applicable law.

Using unauthorized software, bots, scripts, macros, automation systems, scraping tools, crawlers, data mining tools, emulators designed for abuse, or similar methods to interact with or analyze the Services.

Circumventing, interfering with, disabling, or attempting to defeat security measures, technical restrictions, anti-fraud systems, advertising systems, or other protective features.

Fraudulently viewing advertisements, generating invalid ad impressions or clicks, manipulating advertising attribution, falsely generating installs, or abusing rewarded advertisements.

Distributing viruses, malware, harmful software, or other malicious code through or in connection with the Services.

Interfering with, disrupting, damaging, overloading, or impairing the Services or any systems or networks used to provide them.

Copying, reproducing, distributing, selling, licensing, modifying, publishing, or commercially exploiting the Services or Content without authorization.

Using Maze Paint, its levels, gameplay systems, game data, graphics, code, or other Content to create unauthorized identical or substantially similar games, services, analysis tools, cheating tools, or competing products.

Infringing our rights or the intellectual property, privacy, publicity, contractual, or other rights of any third party.

Misrepresenting yourself as us, our representative, or an official representative of Maze Paint.

Attempting to encourage, assist, or enable another person to engage in any prohibited activity described in these Terms.

Engaging in any other activity that we reasonably determine materially threatens the security, fairness, integrity, or operation of the Services.

#8. Measures Against Violations

If we reasonably determine that you have violated these Terms, applicable law, or the security or integrity of the Services, we may take appropriate measures, including:

• restricting access to certain features;
• invalidating improperly obtained progress or rewards;
• modifying or deleting affected Game Data where technically possible;
• preventing or restricting use of the Services;
• preserving relevant logs or evidence;
• reporting fraudulent or illegal activity to app stores, advertising providers, service providers, or competent authorities; or

taking other reasonable measures necessary to protect the Services or third parties.

We will take such actions subject to applicable law.

#9. Intellectual Property Rights

All intellectual property rights and other rights relating to Maze Paint and its Content belong to us or the applicable third-party rights holders.

This includes, without limitation:

• game design;
• game systems and mechanics;
• puzzle and level designs;
• maze layouts;
• visual designs;
• graphics;
• animations;
• user interfaces;
• text;
• logos;
• sounds;
• music;
• software;
• source code;
• algorithms;
• data;

documentation; and

other materials contained in the Services.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, publish, modify, adapt, create derivative works from, publicly display, publicly perform, sell, license, or commercially exploit any part of the Services or Content without our prior permission.

Gameplay Videos and Screenshots

You may generally use screenshots or gameplay recordings of Maze Paint for personal, non-commercial purposes such as:

• social media posts;
• gameplay videos;
• reviews;
• commentary;
• streaming; or

discussion of the App.

Such use must not:

• violate applicable law;
• infringe third-party rights;
• falsely imply that you are affiliated with or officially endorsed by us;
• distribute unauthorized copies of the App or its assets;
• facilitate cheating, hacking, reverse engineering, or unauthorized exploitation of the Services; or

otherwise materially harm the legitimate operation of Maze Paint.

We reserve the right to request removal of content that unlawfully infringes our rights or materially violates these Terms.

#10. No User-Generated Content Features

Maze Paint does not currently provide features that allow users to:

• create public profiles;
• upload images;
• upload custom game content;
• publish custom levels;
• post comments;
• communicate with other users;
• participate in public chat; or

directly share user-generated content with other users through the App.

If such features are introduced in the future, these Terms may be updated to establish appropriate rules governing them.

#11. Third-Party Services

Maze Paint may depend on or interact with Third-Party Services, including:

• the Apple App Store;
• Google Play;
• advertising providers;
• operating system services;

analytics or diagnostics providers; and

other technical service providers.

Your use of Third-Party Services is governed by the terms, privacy policies, and rules of the relevant third parties.

We do not control Third-Party Services and do not guarantee their availability, operation, accuracy, safety, or continued compatibility with Maze Paint.

Changes, interruptions, restrictions, failures, or termination of a Third-Party Service may affect the availability or functionality of all or part of Maze Paint.

#12. App Stores

If you download Maze Paint from the Apple App Store, Google Play, or another authorized application marketplace, your use of that platform is also subject to the applicable platform’s terms and policies.

These Terms are between you and Koh Kobayashi and not between you and Apple, Google, or another app store operator, except to the extent otherwise provided under applicable platform terms.

The applicable app store may have additional rights relating to your use of Maze Paint under its own terms.

#13. Changes to the Services

We may modify Maze Paint from time to time.

Such modifications may include changes to:

• levels;
• puzzle generation;
• game difficulty;
• gameplay mechanics;
• graphics;
• sound;
• user interface;
• rewards;
• advertising frequency or format;
• supported devices;
• supported operating systems;
• technical requirements; or

other game features.

We may also add, modify, temporarily suspend, or permanently discontinue all or part of the Services when reasonably necessary for technical, security, operational, legal, platform, or business reasons.

#14. Service Interruptions

The Services may temporarily become unavailable due to circumstances including:

• maintenance;
• updates;
• bug fixes;
• system failures;
• network failures;
• advertising service failures;
• operating system changes;
• app store changes;
• device compatibility issues;
• security incidents;
• force majeure events; or

other circumstances outside our reasonable control.

We do not guarantee that the Services will operate continuously or without interruption.

#15. Updates

We may provide App updates for purposes including:

• bug fixes;
• gameplay improvements;
• level additions or modifications;
• graphics or sound improvements;
• compatibility updates;
• security improvements;
• advertisement-related changes;

legal compliance; and

new features.

Some updates may be required for continued use of the Services.

If you do not install a required update, all or part of Maze Paint may no longer function properly.

Updates may modify gameplay, levels, game balance, advertisements, visual elements, Game Data formats, or other elements of the Services.

#16. Privacy

We respect your privacy.

Our collection, use, storage, disclosure, and other processing of personal information, device information, advertising information, analytics data, diagnostic information, and other data are governed by our Privacy Policy.

You should review our Privacy Policy before using the Services.

#17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Maze Paint and the Services are provided on an “as is” and “as available” basis.

We do not warrant that:

• the Services will always be available;
• gameplay will always be uninterrupted or error-free;
• all bugs or defects will be corrected;
• Game Data will never be lost;
• advertisements will always be available;
• rewarded advertisements will always grant rewards;
• the Services will operate on every device or operating system;
• all generated or provided levels will always provide the same difficulty or gameplay experience;
• all content will always remain unchanged; or

the Services will always meet your individual expectations.

Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded under applicable consumer protection law.

#18. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential, punitive, or similar damages arising from or related to your use of or inability to use the Services.

This includes, where legally permitted, damages resulting from:

• loss of Game Data;
• loss of progress;
• device failure;
• interruption of the Services;
• failures of advertising providers;
• unavailable rewarded advertisements;
• failures of Third-Party Services;
• operating system changes;
• network failures; or

unauthorized modifications to the App.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms excludes liability for damages caused by our intentional misconduct or gross negligence where such exclusion is prohibited under Japanese law.

Where Japanese consumer protection law, including the Consumer Contract Act, applies, these Terms shall not deprive you of any mandatory rights or protections provided by such law.

#19. User Responsibility

You are responsible for your use of Maze Paint and for complying with these Terms and applicable law.

If your intentional misconduct, unlawful conduct, or material violation of these Terms causes damage to us or a third party, you may be responsible for such damage to the extent permitted by applicable law.

Nothing in this section imposes obligations on consumers beyond what is permitted under applicable consumer protection law.

#20. Suspension and Termination

You may stop using Maze Paint at any time by uninstalling the App.

We may suspend, restrict, or terminate access to all or part of the Services where reasonably necessary, including if:

• you materially or repeatedly violate these Terms;
• you engage in fraud, hacking, advertisement abuse, or other unlawful conduct;
• continued access presents a security or operational risk;
• a Third-Party Service or app store requires such action;
• applicable law or a competent authority requires such action; or

continued operation of the Services is no longer reasonably possible.

Sections that by their nature are intended to survive termination, including intellectual property provisions, disclaimers, limitations of liability, and dispute provisions, will continue to apply where legally appropriate.

#21. Assignment

You may not assign or transfer your rights or obligations under these Terms to another person without our prior written consent.

If the ownership or operation of Maze Paint is transferred in connection with a business transfer, merger, acquisition, reorganization, or similar transaction, we may transfer our rights and obligations under these Terms to the relevant successor, subject to applicable law.

#22. Severability

If any provision of these Terms is determined by a court or competent authority to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.

The affected provision shall apply to the maximum extent permitted by applicable law.

#23. No Waiver

Our failure or delay in exercising any right or remedy under these Terms does not constitute a waiver of that right or remedy.

#24. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law principles.

Any dispute arising out of or relating to Maze Paint or these Terms shall first be addressed through good-faith discussion where reasonably possible.

Unless otherwise required by applicable consumer protection law or another mandatory provision of law, any dispute that cannot be resolved through discussion shall be subject to the jurisdiction of the competent court in Japan having jurisdiction over the location of the service provider as the court of first instance.

Nothing in this section deprives consumers of any mandatory right to bring proceedings before another court where such right is provided by applicable law.

#25. Entire Agreement

These Terms, together with our Privacy Policy and any other rules or notices expressly incorporated into these Terms, constitute the agreement between you and us concerning your use of Maze Paint.
